CONCORD — The New Hampshire Hospital Association is pleased to support S. 3391, the Taking Essential Steps for Testing Act or TEST Act introduced by Senators Jeanne Shaheen (D-NH), Amy Klobuchar (D-MN) and John Boozman (R-AR). The TEST Act will make important changes to existing federal oversight by updating the Clinical Laboratory Improvement Amendments (CLIA) (42 U.S.C. 263a).

By updating CLIA, the Centers for Medicare and Medicaid Services (CMS) will gain flexibility in applying sanctions appropriate to the level of noncompliance with proficiency testing (PT) samples. This will give CMS the regulatory flexibility as part of their important oversight that is essential to ensure the Medicare program is operating appropriately. This change is important for all clinical laboratories, including hospital laboratories, and it supports their commitment to high quality patient care.
